During The Appointment

What is the purpose of the medico-legal assessment?

The appointment is an independent medico-legal assessment relating to your personal injury claim and is not a treatment consultation.

The expert will assess:

  • The accident circumstances
  • Your injuries and symptoms
  • The effect on your daily activities, work, hobbies, and home life
  • Relevant medical history where appropriate

What should I discuss during the appointment?

Please discuss:

  • All injuries and symptoms related to the accident
  • Ongoing pain or restriction
  • Psychological symptoms where relevant
  • Impact on work, sleep, hobbies, or daily activities
  • Treatment received and ongoing symptoms

It is important to provide accurate and honest information during the assessment.

Will I be examined?

A clinical examination may be carried out where appropriate to assist the expert in preparing the medico-legal report.

Can I bring someone with me to the examination?

Yes. You may bring a friend, family member, carer, or support person to the appointment if required.

For examinations involving children or minors, attendance with a parent, guardian, or responsible adult is mandatory.

Should I bring identification?

Yes. Please bring photographic identification where available, such as:

  • Passport
  • Driving licence
  • Another form of photo ID

You may also bring any relevant documentation requested by the instructing party.

The Role Of The Expert

Does the medical expert represent me?

No. The medical expert acts independently and objectively and does not represent either party involved in the claim.

The expert’s role is to provide an impartial medical opinion based on:

  • The history provided
  • Examination findings
  • Available medical records
  • Clinical expertise

What happens after the appointment?

Following the assessment, the expert will prepare a medico-legal report which may be provided to the instructing parties involved in the claim.

Where applicable, reports may also be uploaded to the Official Injury Claim (OIC) portal.

Reports & Amendments

How long does it take for the report to be completed?

Medico-legal reports are normally prepared within 5 working days following the appointment.

In some cases, there may be delays where:

  • Additional medical records are required
  • Further information is needed
  • The expert requires additional time to review records

Can changes be made to the report?

Reasonable clarification requests or factual corrections may be reviewed by the expert where appropriate.

The independent obligations of the expert must always be maintained and not all requested changes may be accepted.

Treatment & Rehabilitation

Will the expert provide treatment?

No. The medico-legal assessment is not a treatment consultation.

However, where appropriate, the expert may comment on:

  • Treatment history
  • Ongoing symptoms
  • Rehabilitation needs
  • Recommendations for further review
Payments

Do I need to pay for the report if I am a Litigant in Person (LiP)?

If your case has been accepted onto the Official Injury Claim (OIC) LiP Portal, the cost of the medical report is normally paid by the compensator.

You will not usually be contacted directly for payment.

Do I need to pay if my appointment was arranged through a solicitor or agency?

No. Where your appointment has been arranged through a solicitor, agency, or Medical Reporting Organisation (MRO), fee arrangements are managed directly between the instructing organisation and the expert.
